Terms of Service Agreement

Effective Date: 12 June 2025

This Terms of Service Agreement (“Agreement”) is a legal agreement between you (“Customer”, “you”) and Vrek Lekker (Pty) Ltd (“Company”, “we”, “our”, or “us”) governing your use of the www.vrek-lekker.com website (“Website”), and any order placed through the Website, WhatsApp, email, or social platforms.
By accessing the Website or placing an order, you agree to be bound by this Agreement.

1. Website Use & Intellectual Property
 

1.1 Ownership of Content

All content on the Website — including text, logos, images, photographs, product descriptions, branding, and design elements — is the property of Vrek Lekker and is protected by copyright and intellectual property laws.

You may not:

  • copy, reproduce, or distribute any content,

  • modify or create derivative works,

  • use any images, videos, or text for commercial purposes

without our explicit written permission.
 

1.2 Acceptable Use

You agree not to engage in:

  • unauthorised access or attempts to breach website security

  • scraping, data mining, or automated data collection

  • activities that disrupt, overload, or interfere with the Website

  • using the Website for fraudulent or unlawful purposes
     

2. Ordering & Payment

2.1 Order Acceptance

All orders placed through the Website are subject to acceptance by Vrek Lekker.
We reserve the right to:

  • refuse, cancel, or limit any order at our discretion

  • request additional information where necessary

  • cancel orders with incomplete or suspicious information
     

2.2 Pricing

Prices are listed in South African Rand (ZAR) and may change without prior notice.

 

2.3 Payment Methods

Payment must be made using one of the approved online payment options or EFT.
By providing payment information, you confirm that:

  • you are authorised to use the selected payment method

  • you authorise us (or our payment partner) to charge the full order value

Payment information is processed securely and never stored by Vrek Lekker.

 

2.4 No Cancellations After Payment

Once payment is made:

  • orders cannot be cancelled

  • orders cannot be amended

  • refunds cannot be issued except where legally required

 

3. Production, Shipping & Delivery

3.1 Production Lead Time

All orders follow a standard 2–4 business day production lead time, excluding courier transit times.

 

3.2 Courier Delivery

We use The Courier Guy for nationwide delivery. Once your parcel leaves our premises:​

  • courier delays are outside our control

  • rerouting, speeding up delivery, or address changes cannot be guaranteed

 

3.3 Delivery Timeframes

Delivery ranges from 1–4 business days, depending on your area, courier volumes, and weather conditions.

 

3.4 Missed Deliveries & Incorrect Details

The Customer is responsible for providing accurate delivery information.
Missed deliveries due to:

  • incorrect address,

  • inability to receive the parcel, or

  • courier attempts

may require additional fees.

 

4. Disclaimers & Limitation of Liability

4.1 Website Information

The Website content is provided for general information only.
We make reasonable efforts to ensure accuracy but do not guarantee:

  • the completeness,

  • correctness,

  • or timeliness

of any website information.

 

4.2 Liability Limitation

Vrek Lekker, its owners, employees, and affiliates will not be liable for:

  • indirect, incidental, or consequential damages

  • courier delays or courier handling

  • allergic reactions or ingredient sensitivities

  • spoilage due to heat or improper storage

  • losses arising from website misuse

Our total liability for any claim will not exceed the amount paid for the specific order in question.

 

5. Indemnification

You agree to indemnify and hold harmless Vrek Lekker, its owners, directors, employees, and partners from any claims, damages, losses, or expenses arising from:

  • your use of the Website

  • your misuse of products

  • your breach of this Agreement

 

6. User-Generated Content

Any photos, videos, ideas, suggestions, comments, testimonials, or content shared with Vrek Lekker (through WhatsApp, email, reviews, or social media) may be used by Vrek Lekker for:

  • marketing

  • product development

  • promotional materials

  • research or brand representation

By submitting such content, you grant Vrek Lekker full permission to use it without compensation.

 

7. Privacy & Data Protection

All personal information is processed in accordance with our Privacy Policy.
We never sell personal information and only share data when necessary to process or deliver your order.

 

8. Modifications, Updates & Termination

We may modify, suspend, or update the Website or these Terms at any time without notice.
Your continued use of the Website signifies acceptance of updated terms.

 

9. Entire Agreement

This Agreement constitutes the entire agreement between you and Vrek Lekker regarding website use and supersedes any prior written or verbal agreements.

 

10. Legal Jurisdiction

This Agreement is governed by the laws of South Africa.
Any disputes will fall under South African legal jurisdiction.
